Your legal guarantee rights

EU notice: legal guarantee

LEGAL GUARANTEE. Minimum two-year legal guarantee protection for goods sold in the European Union. Consumers can claim their rights under the legal guarantee of conformity, for example if goods do not match the description or do not function as intended. Sellers are liable for any lack of conformity which existed when the goods were delivered, and which becomes apparent within the legal guarantee period. Sellers in such a situation are required to offer: free repair or free replacement; in some cases, a price reduction or full reimbursement. Some countries have a longer legal guarantee period. For second-hand goods, a shorter period may apply, but not less than one year. For more information on your rights in a specific country, scan the QR code or ask the seller: europa.eu/youreurope/guarantees. What to do if you receive non-conforming goods: 1. Contact the seller as soon as possible to report the issue. 2. Provide proof of purchase, such as a receipt, invoice, or bank statement. Sellers and producers may also offer commercial guarantees, which apply independently from the legal guarantee. For example, you may see this GARAN label representing a commercial guarantee of durability offered by the producer at no additional cost and covering the entire good.

Terms and Conditions

General Terms and Conditions (AGB) of KTH Parts GmbH. The German version is the legally binding one; this translation is provided for information.

§ 1 Scope, provider

These General Terms and Conditions apply to all contracts concluded between KTH Parts GmbH, Am Tönniesberg 16, 30453 Hannover, Germany (hereinafter “we” or “provider”) and consumers or businesses (hereinafter “customer”) via the provider’s online shops – the KTH online shop and the online shop “BlackBoost Europe”. Deviating terms of the customer do not apply unless we expressly agree to them in writing.

§ 2 Conclusion of contract, storage of the contract text

The presentation of products in the online shops does not constitute a legally binding offer but an invitation to place an order. By submitting the order via the order button, the customer makes a binding offer to conclude a purchase contract. The contract is concluded when we accept the order by the e-mail “Order confirmation” or dispatch the goods. For payments via Stripe (credit card, Apple Pay, Google Pay, PayPal, Klarna, Amazon Pay) the customer first receives the e-mail “We have received your order”, which does not constitute acceptance; the order confirmation follows after successful payment.

Before submitting the order, the customer can review all entries on the checkout page and correct them using the usual keyboard and mouse functions or by returning to the shopping cart.

We store the contract text. The customer receives the order data, these terms and conditions and the withdrawal notice by e-mail with the order confirmation. Customers with a customer account can also view their orders there.

§ 3 Customer account

A customer account may be created for certain functions. The customer is obliged to keep the access data confidential and to protect it from access by third parties. The customer account is not transferable. A customer account is valid for both online shops of the provider.

§ 4 Prices and terms of payment

All prices are in euros and include the applicable statutory value added tax. For information purposes, the prices displayed in the shops may show the VAT of the country determined from the visitor’s location; the final price calculated in the ordering process on the basis of the country of the delivery address is always decisive. Shipping costs as well as any customs duties and import charges for deliveries to third countries are shown separately or are to be borne by the customer. The payment methods displayed in the ordering process for the respective delivery country apply; currently prepayment (bank transfer to our account), credit card, Apple Pay, Google Pay, PayPal, Klarna and Amazon Pay. Approved business customers may additionally be offered purchase on account. Payments other than prepayment and purchase on account are processed by Stripe Payments Europe, Ltd. (Ireland). For payments with Klarna (pay later, instalments or pay now; consumers only), Klarna's terms apply in addition. For prepayment, the purchase price is to be paid within 14 days of the order stating the payment reference provided; the goods are dispatched after receipt of payment. No fees are charged for the choice of a payment method.

§ 5 Gift cards and discount codes

Gift cards can be redeemed in the ordering process and cannot be paid out in cash. Any remaining balance is retained for future orders. Discount codes apply in accordance with the respective promotion conditions, cannot be combined with other discount codes and can only be redeemed once per order.

§ 6 Delivery and shipping

The delivery time is stated for each item and in the ordering process. For prepayment and bank transfer it begins on the day after receipt of payment, for all other payment methods on the day after conclusion of the contract, and ends on expiry of the last day of the period; if this falls on a Saturday, Sunday or public holiday at the place of delivery, the next working day takes its place. For consumers, the risk of accidental loss and accidental deterioration of the goods passes upon handover to the consumer; for businesses, upon handover to the carrier. Partial deliveries are permissible insofar as they are reasonable for the customer; no additional shipping costs arise as a result.

We deliver to the countries shown in the ordering process, currently Germany, all other Member States of the European Union and Monaco, except territories to which deliveries are not possible due to embargoes, sanctions or carrier restrictions. Deliveries to Great Britain (excluding Northern Ireland) are only possible for a goods value exceeding GBP 135 per consignment.

Where we offer deliveries outside the EU VAT area in the ordering process (third countries and special territories such as the Canary Islands), they are made as exports without German VAT on the terms “Delivered at Place” (DAP): customs duties, import VAT and the carrier’s clearance fees in the destination country are borne by the customer. The customer is responsible for compliance with import regulations and any import permits in the destination country. The statutory right of withdrawal remains unaffected.

§ 7 Right of withdrawal

Consumers are entitled to the statutory right of withdrawal. Details are set out in the withdrawal notice. Withdrawal may also be declared via the electronic withdrawal function (“Withdraw from contract”) in the online shops.

§ 8 Retention of title

The goods remain our property until paid in full.

§ 9 Legal guarantee (warranty)

The statutory rights in respect of defects (legal guarantee of conformity) apply. For consumers, the limitation period is two years from delivery of the goods. If a defect becomes apparent within one year of delivery, it is presumed to have existed at delivery (§ 477 BGB).

In the event of a defect, the consumer may choose between repair and replacement (supplementary performance, § 439 BGB); before supplementary performance we inform the consumer of this choice. If we remedy a defect by repair, the limitation period is extended once by twelve months for consumers (§ 475e BGB; contracts concluded from 31 July 2026). If supplementary performance fails, the customer may reduce the price or withdraw from the contract; claims for damages are governed by § 10.

For businesses, the warranty period is one year from delivery of the goods; this does not apply to claims for damages, claims for fraudulently concealed defects and claims under a guarantee assumed by the provider. The reduction does not apply to recourse claims under §§ 445a, 445b, 478 BGB. § 377 of the German Commercial Code (HGB) remains unaffected.

We do not give a guarantee of our own. Manufacturers’ guarantees apply in addition to the statutory rights in accordance with the respective guarantee statement and do not restrict them. Further information, including the EU notice on the legal guarantee, is available on the “Warranty & guarantee” page of the online shops.

§ 10 Liability

We are liable without limitation for intent and gross negligence as well as for injury to life, body or health. In the case of slight negligence, we are liable only for breach of essential contractual obligations (obligations whose fulfilment is a prerequisite for the proper performance of the contract and on whose observance the customer may regularly rely), limited to the foreseeable damage typical for the contract. Liability under the German Product Liability Act remains unaffected.

§ 11 Product notices and type approval

Whether a product may be used on public roads is stated for each item (e.g. ABE (general operating permit), parts certificate (Teilegutachten), ECE or EC approval). Products marked “Without road approval” are demonstration and display pieces only; they are not intended for use on public roads, race tracks or in motorsport. For products marked “Approval status not conclusively confirmed” we hold no evidence of a part approval. Modifying a vehicle without the required approval, inspection or registration may invalidate its operating permit (§ 19 (2) StVZO). All brand and manufacturer names serve solely to describe technical compatibility (“for”); the products are not original products of the respective vehicle manufacturers.

§ 12 Intellectual property

All content of the online shops (texts, images, graphics, logos) is protected by copyright. Any use without prior written consent is prohibited.

§ 13 Data protection

The processing of personal data is governed by our privacy policy.

§ 14 Final provisions, dispute resolution

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted by mandatory provisions of the law of the state of their habitual residence is not withdrawn. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Hannover. The contract language is German; English-language presentations in the online shop “BlackBoost Europe” are for information purposes only. Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions remains unaffected.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§§ 36, 37 VSBG).
